RB Innovations Inc. manufactures and sells only RBI branded products. When our site lists products by brand compatibility we do reference major brands some of which are trademarked. We are not an official distributor of these major brands and do not have the respective authorization to use such trademark. However brands trademark is used as nominative fair use.
Nominative fair use; RB Innovations Inc. uses a third party’s trademark in order to inform the consuming public about a product’s fit with another product. The USA Supreme Court encourages the use of third party trademarks in compatibility advertising because it “assists consumers and furthers the societal interest in the fullest possible dissemination of information.” It is unfortunate that some major brands have lost their way and levy a heavy handed approach with small brands that helped build the industry.
